Terms of service
These terms govern use of heardback.co and the Heardback service by askers (people and organisations that create surveys) and respondents (people who answer them). By using the service you agree to them. Heardback (company in formation) ("Heardback", "we"), [registered address to be added], India.
1. The service
Heardback lets an asker publish a short survey through a link. Respondents answer one question at a time and may receive a reveal card that compares their answer with the answers collected so far. Askers commit to a decision they will make with the answers and a date by which they will tell respondents what they decided (a "receipt"). Later phases add a WhatsApp channel, AI follow-up questions, and a synthesis of results.
2. Respondents
- You must be 18 or older.
- Answering is voluntary. You can skip any question, stop at any time, and download or delete everything you gave us from the delete page.
- A reveal card is a statistic about the people who answered that survey. It is not research, advice, or a statement about you.
- You may share your card. The card carries a referral link; we count arrivals from it and nothing more.
- Do not submit content that is unlawful, that infringes someone else's rights, or that contains other people's personal data.
3. Askers
- You are the controller of the answers your survey collects and are responsible for having a lawful basis to ask, for the questions you publish, and for the decision and report-back date you commit to. The data processing addendum forms part of these terms for askers.
- You must not ask for special-category or sensitive personal data (health, religion, sexuality, political opinions, biometrics, financial account details, government identifiers) unless you have a specific lawful basis and tell us before publishing.
- You must not impersonate another person or organisation, run surveys that harass or deceive, use the service to send unsolicited messages, or try to identify individual respondents from aggregate results.
- You must keep your report-back commitment or tell respondents, through the service, that the decision has been postponed.
- Questions drafted with AI assistance are suggestions. You review and approve them before publishing and you are responsible for what goes live.
4. Accounts and access
Asker accounts use a magic link sent to your email; keep that email secure. During the pilot period accounts are free and limited to 50 completed responses per survey. We may suspend an account that breaches these terms, and will tell you why unless the law prevents it.
5. Credits and payment (when enabled)
Credits are purchased per completed response in USD, with local-currency display where offered, plus applicable taxes. Prices are shown before purchase and the price in force when you buy applies to those credits. Unused credits are refundable within 14 days of purchase if none have been used; otherwise they remain on the account and do not expire for 24 months. Consumer protection rights that cannot be excluded by law are not affected.
6. Intellectual property
You keep the rights to your questions and your answers. You grant Heardback a licence to process them to provide the service, including generating cards and aggregate statistics, and to use aggregate, non-identifying statistics to improve the service. Heardback keeps the rights to the service, its design and its software.
7. AI outputs and statistics
Cards, interpreted values, drafted questions and syntheses are produced with statistical and AI methods and may be wrong or incomplete. They are provided for information and must not be relied on as professional advice of any kind, including legal, financial, medical or investment advice.
8. Availability and changes
We aim for continuous availability but do not guarantee it. We may change or withdraw features with reasonable notice to askers. During the pilot period the service is provided as a preview.
9. Warranties and liability
The service is provided "as is". To the extent permitted by law we exclude implied warranties and are not liable for indirect or consequential loss. Our total liability to an asker for any claim is limited to the amount that asker paid us in the twelve months before the claim. Nothing limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law. Nothing in these terms limits the statutory rights of consumers in their country of residence.
10. Privacy
Our privacy notice explains how we handle personal data. It is part of these terms.
11. Governing law and disputes
These terms are governed by the laws of India and the courts of the city of our registered office have jurisdiction, except that consumers may bring claims in the courts of their own country of residence where the law gives them that right, and nothing in this clause prevents either party seeking urgent relief in any competent court. We will try to resolve any dispute informally first; write to privacy@heardback.co.
12. Changes to these terms
We will post changes here with a new version and effective date and, for material changes, notify askers by email at least 14 days before they take effect.
